Unlawful sexual contact with a minor can be charged a number of different ways under Pennsylvania law. Indecent Assault & Unlawful Sexual Contact Defense

Such cases can be charged depending on if penetration occurred or a minor was involved:

  • Unlawful Contact with a Minor: This charge accuses a defendant of coming into contact with a minor (or a cop poses as a minor) for any sexually related purpose.
  • Indecent Assault: First- or second-degree misdemeanor. Sexual contact with an unwilling victim.
  • Aggravated Indecent Assault: Any sexual penetration without consent.

The unlawful contact with a minor statute is particularly problematic. Not only does it not require contact with a minor (a law enforcement officer posing as a minor is good enough), it doesn't even require physical contact. Contact by electronic means – including computer or text messaging, is good enough. Conviction can result in a permanent felony record as a sex offender.

Pittsburgh Sex Charge Defense and Sex-Offender Registration

Under Pennsylvania's sex-offender registration law, or Megan's Law, any of these offenses can result in a defendant being required to register as a sex offender upon conviction. Unlawful contact with a minor and indecent assault require a 10-year registration period. Aggravated indecent assault can result in lifetime sex-offender registration. Those required to register as a sex offender must do so within 48 hours of changing addresses, jobs or schools. Information available to the general public via the sex-offender website will include your name, year of birth, street address, photograph, physical description, license plate number and description of vehicle, and a description of the convicting offense.
